Kane says she won’t prosecute the case because she has concerns about a cooperating informant, and because she believes investigators were told “to focus only on the black caucus.” Kane believes eight people took about $20,000, but that the investigation of the Philadelphia lawmakers and other officials was dormant by the time she took office last year.

Montgomery County prosecutors say investigators misinterpreted laboratory evidence in wrongly concluding that County GOP Chairman Robert Kerns had drugged the woman’s wine at an office party in October. Kerns has always asserted his innocence.

The commission says former LCB chairman Patrick Stapleton III, chief executive Joe Conti and marketing director James Short violated the ethics law when they did not report accepting the gifts.
