NEW – Clark seeking new trial in Bedford murder

BEDFORD Joseph Clark, the Bedford County man serving life for the kidnapping and murder of Holly Notestine, had filed a motion seeking a new trial.

Clark, 49, of Everett, was sentenced last month to life in state prison without the possibility of parole in the slaying of Notestine in 2000.

He was convicted of first-degree murder at his second trial in June by a jury brought in from Dauphin County. His trial earlier this year ended in a hung jury.

Pittsburgh Attorney Barbara Weiss, one of Clark’s defense lawyers, is contending that there were legal errors warranting a new trial.

But District Attorney William Higgins is expressing confidence that Clark’s appeal will be rejected, both by the county court and state courts.

Judge Daniel Howsare has set a hearing for Nov. 12 on the defense’s motion.
