Westmont driver waives hearing on fatal wreck

JOHNSTOWN — The case against a Westmont woman charged in connection with a crash that killed her husband last year is headed to Cambria County court.

Misty C. Petrick, 35, is charged with homicide by vehicle while driving under the influence, aggravated assault by vehicle while driving under the influence, DUI and reckless driving.

She waived her right to a preliminary hearing before District Judge John Barron of Stonycreek Township on Monday.

West Hills Regional police said Petrick was driving a 2006 Ford Mustang GT coupe about 1:30 a.m. Aug. 4 when she lost control in the 1600 block of Emmett Drive and struck a tree, killing Jamey T. Petrick, 44.

Her blood-alcohol level was 0.151 percent, nearly twice the legal limit for drivers, according to the criminal complaint filed by police.

An autopsy conducted at Memorial Medical Center in Johnstown showed James Petrick died of multiple blunt force trauma to the chest and abdomen with hemothorax and intra-abdominal bleeding, the complaint says.

“They were just out for the evening at several establishments and were going to stop and have one more,” police Sgt. George Musulin III said when the charges were filed in October.

A state police accident reconstructionist determined the vehicle was traveling between 37 and 40 mph in a 25 mph zone,

Police said that when they arrived at the crash scene, they found Misty Petrick without shoes and a bottle of alcohol in the back seat.

Petrick, of the 1000 block Omar Drive, remains free on unsecured bond.
