UPDATE – Shooting victim identified

JOHNSTOWN — The man who was shot and killed Sunday night on the outside porch of a third-floor West End apartment has been identified as 29-year-old David Edward Turner of Johnstown’s Moxham section.

Turner was shot as he was attempting to enter the apartment of Andrew Peter Herdman around 6:30 p.m., authorities said today.

District Attorney Patrick Kiniry said the the investigation into the shooting was continuing with police and prosecutors carefully reviewing whether justifiable deadly force for the protection of property was used.

Herdman, 25, who was inside his apartment, shot through a metal door, with the slug hitting Turner in the chest, officials said.

Herdman has not been charged in the shooting, but he’s been arrested on charges that he allegedly had a large amount of heroin inside the apartment. He’s been lodged in the county prison in lieu of $250,000 on the drug charges.
